JUDGEMENT

(1.) Respondents No.1 and 2 had faced trial in FIR No.69 dated 21.11.2006 under Sections 7 and 13 of the Prevention of Corruption Act, 1988 registered at Police Station SVB, Ambala.

(2.) Prosecution story in brief was that on 14.11.2006, Sham Lal had lodged FIR No.111 dated 14.11.2006 at Police Station Shehjadpur. Investigation of the said case was handed over to respondent Nos.1 and 2. The said respondents visited the house of the complainant and demanded Rs.2,000/- from her and threatened her that in case, the said amount was not paid to her, they would arrest her son in the FIR registered at the instance of Sham Lal on 21.11.2006. Respondent Nos.1 and 2 visited the house of the complainant and matter was settled at Rs.2,000/-. Complainant approached the Vigilance Department. Complainant handed over four currency notes in the denomination of Rs.500/- each to the Vigilance Inspector who returned the same to the complainant after application of Phenolphthalein Powder (hereinafter referred as PPowder) Complainant was directed to hand over the said currency notes to respondents Nos.1 and 2 on demand. Assistant SubInspector Rajinder Kumar was appointed as a shadow witness and was directed to give a signal to the raiding party after the bribe money was accepted by respondent Nos.1 and 2. Pratap Singh, Naib Tehsildar was joined as an official witness. Thereafter, the raiding party reached at Police Station Shehzadpur. Complainant handed over the bribe money to respondent-Mange Ram on demand.

(3.) On receipt of signal from the raiding party, Vigilance Inspector as well as the other members of the raiding party reached the spot. Currency notes were recovered from the ground as on seeing the police party, accused had thrown the same on the ground.
