JUDGEMENT

(1.) This case was treated as a criminal writ petition, on the telegram received in the Secretariat of Hon'ble the Chief Justice, sent by one Nachhattar Singh, on 21.9.2012, stating therein that his wife, Bhupinder Kaur, had been picked up by two unknown ladies and men in civil dress, claiming to be police officials, without giving any prior intimation to the school in which she was teaching and without prior intimation to the other teachers with regard to the same and that the police of Police Station Dehlon, Ludhiana, has taken her to an unknown place.

(2.) The petitioner further alleged that his wife had been picked up because FIR No.4 dated 15.5.2012, had been registered at her behest under Sections 7(13) (2) of the Prevention of Corruption Act, 1988, at Police Station Vigilance Bureau, Ludhiana against one ASI Balwinder Singh. Further, that his wife was supporting the prosecutrix, in another case registered under Section 376 IPC, against the same official. That FIR, is FIR No.60 dated 13.6.2012, registered at Police Station Division No.8, Ludhiana. As a result of this, his wife had been picked up, only to pressurize her to get the said FIR withdrawn and not to support the complainant in the other FIR.

Subsequently, on notice being issued in this case, reply by way of affidavit was filed by the Assistant Commissioner of Police, Gill-Rural, Ludhiana, stating therein that, as a matter of fact, FIR No.21 dated 29.2.2012 had been registered under Sections 420, 506, 120-B IPC at Police Station Sadar, Ludhiana, against the wife of the petitioner and 13 other accused, on the allegations of extracting money, on the pretext of sending the son of the complainant in that case, to Canada.
