JUDGEMENT

(1.) Appellant has preferred this appeal challenging his conviction and sentence for commission of offence punishable under Section 7 of the Prevention of Corruption Act, 1988 (for short 'the Act') as ordered by the Special Judge vide judgment/ order dated 7.4.2003/ 8.4.2003 in FIR No.24 dated 28.7.1994 registered at Police Station State Vigilance Bureau, Gurgaon.

(2.) Prosecution story, in brief, is that on 28.7.1994, complainant Krishan Kumar met Deputy Superintendent of Police, vigilance in his office. Complainant got recorded his statement that he had moved an application before Tehsildar, Jhajjar for demarcation of his land situated in village Dhakla. The said application was marked to Girdawar for doing the needful. Since the Girdawar was not available, complainant met the appellant, who was posted as a patwari, in Dharamshala opposite to police station Jhajjar. Appellant demanded Rs. 500/- from the complainant to demarcate his land. The complainant paid Rs. 200/- to the appellant and agreed to pay the remaining amount of Rs. 300/- after 2-3 days.

(3.) Thereafter, the complainant approached the vigilance department.
