JUDGEMENT

(1.) Appellant has preferred this appeal challenging his conviction and sentence for commission of offence punishable under Sections 7 and 13 (1) (D) of the Prevention of Corruption Act, 1988 (for short 'the Act') as ordered by the Special Judge vide judgment/ order dated 16.5.2003/ 17.5.2003 in FIR No.16 dated 16.7.2001 registered at Police Station Vigilance Bureau, Rohtak.

(2.) Prosecution story, in brief, is that appellant was working as Junior Engineer with the Electricity Board, Sonepat. On 13.7.2001, appellant visited the house of complainant Kuldeep and checked the meter. The meter was not in a working order. Appellant alleged that it was a case of theft of energy and hence demanded Rs. 2,000/- as bribe from the complainant party. The matter was settled at Rs. 1,000/-. Complainant approached the vigilance department.

(3.) Inspector Vigilance joined Bansi Lal, Naib Tehsildar with the raiding party. Complainant handed over two currency notes in the denomination of Rs. 500/- each to the Inspector Vigilance, who, in turn, returned the same to the complainant after application of Phenol Phthalein Powder (P-Powder for short). Complainant was directed to hand over the tainted currency notes to the appellant on demand.
