JUDGEMENT

(1.) Petitioner has challenged order dated 11.2.2013 and 02.09.2013 passed by the Commissioner and Financial Commissioner respectively.

(2.) The brief facts of the case are that respondent No.3 was the owner of 123 kanals 1 marla of land. One Pavitar Singh and Ganga Singh were cultivating his land to the extent of 79 kanals 6 marla which was sold by Ganga Singh to Pavitar Singh by three sale deeds on the basis of a forged power of attorney. Respondent No.3 challenged the validity of the sale deeds dated 10.12.1995, 21.12.1995 and 29.12.1995 and power of attorney dated 9.10.1995 by Civil Suit No.348 of 1996 in which a compromise was effected between the parties on 1.3.1997 and it was agreed that the purchaser namely, Pavitar Singh will execute the sale deeds in favour of respondent No.3/Prithipal Singh and will cooperate to rectify the concerned revenue papers but Pavitar Singh and Ganga Singh would continue to cultivate the land in question and maintain the record. It was also agreed that once the sale deeds are executed in favour of respondent No.3 by Pavitar Singh, the dispute regarding power of attorney would also be over. The said compromise was singed by all the parties and their respective advocates.

(3.) The compromise dated 1.3.1997 was produced in the Civil Suit, filed by respondent No.3, as Ex.C-1.
