THIS appeal has been directed by Ajai Vikas Singh against the judgment and order dated 16.7.2001 passed by the learned Additional Sessions Judge, Ludhiana whereby he was found guilty and convicted under Section 18 of the Narcotic Drugs and Psychotropic Substances Act, for keeping gin his possession 1 Kg. and 400 Gms. of opium without any permit and was sentenced to undergo rigorous imprisonment for 10 years and fine of Rs. one lac; in default of payment of fine he was further sentenced to undergo R.I. for one year.
(2.) COUNSEL for the appellant has not pressed the appeal on merits. He has stated that the appellant has already undergone the sentence of 3 years and the quantity of the opium alleged to have been recovered from the appellant is non-commercial quantity. In such circumstances, taking a lenient view, the appellant is sentenced to the imprisonment already undergone. However, he is directed to pay Rs. 10,000/- as fine. In default of payment of fine, he will undergo R.I. for two months. This appeal stands disposed of accordingly. Appeal allowed.
