JUDGEMENT

(1.) THIS is petition under Section 16 of the Land Revenue Act, 1887 for reopening of a partition already sanctioned by the Assistant Collector 1st Grade, Mansa on 28.1.1966.

(2.) I have listened to the learned counsel for the petitioners and perused the petition filed before this court. The land of joint holders was partitioned on 28.1.1966 by the Assistant Collector Ist Grade, Mansa. It has been admitted by the petitioners that passage was provided to all the Taks in the final partition. The present petition has been filed after a lapse of about 37 years from the date of original order. I am of the view that if such applications are entertained at such a belated stage, there will be no limitation to litigation and no order will ever attain finality. I, therefore, find no justification in entertaining the present petition at this juncture. The present petition is accordingly rejected as being not maintainable. Announced. Petition dismissed.
