JUDGEMENT

(1.) THE only dispute surviving in the present appeal is with regard to the valuation of the tube-well which was acquired along with the land belonging to the claimant-appellant.

(2.) A notification under Section 4 of the Land Acquisition Act, 1894 (hereinafter referred to as 'the Act') was issued on May 10, 1979, which was published on June 8, 1979. Subsequently, notification under Section 6 of the Act was published on October 4, 1979, whereby the land as well as the super- structures standing thereupon were acquired.

(3.) THE claimant felt dissatisfied. He claimed a reference. The matter was referred under Section 18 of the Act to the learned Additional District Judge, Bhatinda
