The petitioners who are working as Clerks in Kurukshetra University, Kurukshetra, have filed the present writ petition for issuance of a writ of Mandamus to the respondents to remove the anomaly in the pay scale of Clerks and in the alternative to issue direction to the respondents to grant the pay scale of Rs.420 700 with effect from 1.4.1979 and Rs. 1200-2040 w.e.f. 1.1.1986.
(2.) The case put forward by the petitioners is that their pay scale w.e.f. 1974 was Rs. 120-300 whereas the clerks of Haryana Government were getting the pay scale of Rs. 110-250. It is also the case of the petitioners that 80% of the posts of Clerks are filled up by direct recruitment and 20% by way of promotion from IV Class employees who possess essential qualification viz Lab. Attendant, Library Attendant, Restorer etc.
(3.) It is also the stand of the petitioners that pay scale of 4th class category like Lab. Attendant, Library Attendant and Restorer were always lesser to that of Clerks. Details have been given in para 5 of the writ petition. The pay scale of these feeder categories have been equated to promotion posts so the pay scale of clerks must be further revised. Reference has also been made to recommendation of Anomaly Committee as published in Indian Express dated 5.3.1989 to the effect that the pay of promotional post should be higher than feeder categories. Representations P-3 to P-7 made by the petitioners proved futile.
