(1.) The petitioner is aggrieved by the order dated Dec. 13, 1991 by which he was ordered to be retired when he had completed almost 57 years of age. A few facts relevant for the decision of the case may be noticed.
(2.) The petitioner joined service as an Inspector in the Department of Cooperative Societies in the year 1958. He was promoted to the rank of Assistant Registrar on Sept. 11, 1970. In 1982, he was permitted to cross efficiency bar w.e.f. Sept. 1, 1977. He was still further promoted to the post of Deputy Registrar vide order dated Sept. 8, 1988. He is due to superannuate in Dec., 1992. This tenure of service is sought to be cut short by the impugned order. This order has been challenged as being totally arbitrary and unfair.
(3.) In the written statement filed on behalf of the respondent, the impugned order is sought to be justified on the basis of the petitioner's record of service. Mr. Jaswant Singh, learned counsel for the respondent, has produced before me the file containing the Confidential reports of the petitioner. A perusal thereof shows that the confidential Reports upto the year 1988-89 are available. On the instructions from Mr. Jai Singh, dealing hand Mr. Jaswant Singh states that the reports for the subsequent period are not available.
