JUDGEMENT

(1.) It is clear from the order of this Court dated 26th August, 1991, that the petitioner has cleared her Part-II of BAMS Course, the result whereof was duly communicated in the month of June, 1991. Thereafter, the petitioner was allowed to appear in Part-III of the said Course under the orders of this Court and the result of the petitioner for that year was also declared which enabled her to join Part-IV of BAMS Course. Mr. Kohli states that thereafter under the orders of this Court, the petitioner was allowed to appear in Part-IV of the said examination as well and result whereof has not been declared so far.

(2.) From the resume of the above facts, it is clear that the petitioner has got through the Part-II and Part-III Course successfully and has appeared in Part-IV of the said Examination. By dismissing the writ petition at this stage, it would be throwing her back in point of time for a number of years which would not be equitable. Keeping in view the peculiar facts and circumstances of the present case, a direction is issued to the respondents that the petitioner be allowed to continue her study by treating her as having passed the Part-II and Part-III Examination.

(3.) The Writ Petition stands disposed of in the above terms with no order as to costs.
