JUDGEMENT

(1.) In this petition under Sections 11 and 12 of the Contempt of Courts Act, the Principal grouse is that the respondent has violated the order of this Court dated September 18, 1991. The same reads thus :-

(2.) The recoveries were thought to be made at the rate of Rs. 200/- p.m. and Rs. 150/- p.m. from Class III and Class IV employees, respectively, by the respondent. The validity of this order was challenged in CWP No. 14408 of 1991. The operation of this order was stayed, but the order was communicated to the respondent on September 24, 1991. The deductions had already been effected for the months of August and September, 1991.

(3.) Learned counsel for the petitioners submits that the order becomes effective from the date it is passed and not from the date it is communicated. This is not the correct position of law. The order becomes effective when it is communicated and not prior thereto. The respondent in Paragraph 4 of the reply stated thus :-
