(1.) Shri K.S. Brar, Advocate, for the respondent has filed an adjournment slip seeking adjournment. However, Shri Battas has stated that he has been informed by Shri Brar that the parties have arrived at a compromise between them and have agreed to seek divorce by mutual consent under Section 13-B of the Hindu Marriage Act. Sh. Battas has also filed an application under Section 13-B of Hindu Marriage Act for dissolution of marriage.
(2.) The statement of the parties have been recorded. The statement of Sukhdev Singh, Lambardar, has also been recorded. He has identified that parties. According to the statement of the parties and Sukhdev Singh, Lambardar, a sum of Rs. 60,000/- has been paid by Mewa Singh to Tej Kaur by way of permanent alimony and final settlement of all her claims against him. Sukhdev Singh, Lambardar, has stated that the parties have agreed to settle their dispute by seeking a decree of divorce by filing petition under Setion 13-B of the Hindu Marriage Act by mutual consent. The petitioners, Counsel has relied on Division Bench judgment of this Court in (Sic)Nirmal Kanta reported as 1990(1) All India Hindu Legal Rights, wherein, in identical circumstances, a Division Bench of this Court had allowed the petition for divorce by mutual consent under Section 13-B of the Hindu Marriage Act and granted decree for divorce by mutual consent.
(3.) Relying on the ratio of the said judgment and having regard to the statements of the parties, the petition is allowed and the marriage between the parties is dissolved by a decree of divorce by mutual consent under Section 13-B of the Hindu Marriage Act.
