Petitioner Ms. Sukhwinder Kaur has invoked the writ jurisdiction of this Court for the quashing of the order dated 10th February, 1992, passed by the Registrar, Punjab Nurses Registration Council, Chandigarh, by which the result of the petitioner, declaring her successful in the pre-entrance test for admission to the General Nursing and Midwifery and Multipurposes Health Worker (Female) A.N.M. Course, in which she was placed at number one in the order of merit in the category of backward classes, has been withheld. The reason disclosed by the respondents in support of their action is that the roll number has been issued to the petitioner due to rush of work, but as her percentage of marks in the 10 + 2 examination was less than 50, she had been wrongly permitted to compete in the test. Otherwise, the petitioner does possess the academic qualifications as she has passed 10 + 1 examination having scored 55 per cent of marks and has also done her B.A. Part I and Part II in Second Division. At present, the petitioner is student of B.A. Part III and thus claims to have higher qualifications than other candidates as also higher than the minimum qualification required for the test.
(2.) The petitioner belongs to the backward class category and applied for admission to the Course against the said category. She passed the pre-entrance test by securing 124 marks out of 200. On that basis, the result was intimated to her - as per the result card sent to the petitioner. Thereupon she was called by the respondents for interview on 27th January, 1992, and was finally selected, but on 10th February, 1992, she was informed by the respondents vide the impugned communication that it was by mistake that she has been allowed to compete in the test.
(3.) In the written statement, the factual position has been admitted and the impugned action is sought to be justified on the ground that due to rush of work, the petitioner was permitted to compete in the test, as roll number had been issued to her due to over sight and rush of work.
