(1.) (Oral) - This order will dispose of CWP Nos. 5655 and 5887 of 1992. The facts as stated in CWP No. 5655 of 1992 may be noticed.
(2.) The three petitioners herein appeared for interview and other tests for recruitment as Constables on April 27, 1992 and April 29, 1992. After having qualified the physical test, they were sent to the Chief Medical Officer for medical examination. After selection, the petitioners were given orders of appointment on April 30, 1992. The petitioners aver that they were allotted constabulary numbers and had been supplied the uniforms etc. In the first week of May 1992, the then Superintendent of Police is alleged to have been transferred. The new Superintendent of Police is alleged to have asked the petitioners to vacate the premises of Police Lines on May 10, 1992 as the appointments of the petitioners had been cancelled. Feeling aggrieved, the petitioners have approached this court through these petitions and challenge the action as being totally arbitrary.

In the written statement filed on behalf of the respondents, it has been stated by way of preliminary objection that there is serious dispute on facts and that the petitioners' services have been terminated as they did not fulfil the conditions as laid down in Rule 12.15 of the Punjab Police Rules. It has been further mentioned that there were certain complaints in this behalf. Directions were issued by the Deputy Inspector General, Hissar Range vide his letter dated May 4,1992 for the physical measurement of the candidates recruited in Jind District on April 27, 29 and 30, 1992. Physical measurements were carried out on May 9, 1992. On measurement, it was found that the petitioners did not fulfil the conditions as laid down in Police rule 12.15(1). They were consequently discharged from police service with effect from May 10, 1992. Copy of the order has been produced as Annexure R-1 with the written statement.
