JUDGEMENT

(1.) The present petition has been filed under Section 438 of the Code of Criminal Procedure, for grant of anticipatory bail to the petitioners in case FIR No.52 dated 03.04.2012, registered under Sections 420, 467, 471, 447, 427, 323, 506, 120-B of the Indian Penal Code, (for short, 'the IPC') at Police Station DLF Phase-I, District Gurgaon.

(2.) The learned counsel for the petitioners contends that the trespassing on the part of the petitioners is not proved. He further submits that there is no overwriting as the learned Judge has not referred or seen the record. If at all there is overwriting, the same is done by the revenue officials. The petitioners are entered as gair marusi since 1962-63. The learned counsel further refers to the statement of the Tehsildar that there is no violation.
