JUDGEMENT

(1.) This petition has been filed under Section 439 of the Code of Criminal Procedure, 1973 for grant of regular bail in case FIR No.39 dated 8.4.2010, under Sections 302, 201/ 34 of the Indian Penal Code , 1860 registered at Police Station Jhansa District Kurukshetra.

(2.) Learned counsel for the petitioner has submitted that out of 53 witnesses only 14 witnesses have been examined so far.

(3.) Material witnesses have already been examined during trial. Initially in the FIR, no suspicion was raised by any person. PW-9 Balkar Singh, alleged eye witness to the occurrence, had moved an application after about 1 month of the occurrence that his statement be recorded. Even as per the said witness the deceased was strangulated by Karam Singh. The petitioner is in custody since 2.8.2010.
