(1.) The appellant Captain Kuldeep Singh Yadav filed a petition under Section 13(1)(i)(a) of the Hindu Marriage Act, 1955 seeking dissolution of the marriage between the parties by a decree of divorce. The petition was dismissed by the learned District Judge (Family Court), Gurgaon vide his judgment and decree dated 31.1.2012. Aggrieved against the same, he filed the present appeal in this Court. The matter was referred to the Mediation and Conciliation Centre in the High Court. The parties to the matrimonial dispute reached at a settlement in the Mediation and Conciliation Centre on 2.7.2012, the terms of which have been reduced into writing.
(2.) Today, when the case was taken up, respondent Smt. Aruna Yadav is present and her statement has been recorded. It is stated by her that her marriage was solemnized with the appellant at Gurgaon on 2.11.2006 according to Hindu rites and ceremonies. Besides, it is submitted that in the Mediation and Conciliation Centre, a compromise was reached at on 2.7.2012.
(3.) She has seen the said compromise and identified her signatures on each page of the said compromise which has been tendered in evidence as Ex.C1. It is stated that the said compromise Ex.C1 has been entered into by her with her own free will and desire and without any kind of pressure or undue influence of anyone. Besides, she is satisfied with the terms of the compromise and shall remain bound by the same.
