THE present petition has been filed under Section 482 Cr.P.C. on behalf of petitioners, namely, Bhupinder Singh, Kishan Chand, Sandeep Singh, Bhupinder Kaur @ Lovepreet Kaur and Amarjit Kaur for quashing of FIR No. 131 dated 23.7.2007 registered under Sections 420/494/465/466/468/471/120-B IPC at Police Station Dharamkot, District Moga as well as all subsequent proceedings arising therefrom on the basis of compromise annexed as Annexure P-3 with the petition.
(2.) LEARNED counsel for the petitioners contends that it is a case of matrimonial dispute and the petitioners have falsely been implicated in this case. LEARNED counsel further contends that now the dispute between the parties bas been settled before the Mediation and Conciliation Centre and the compromise has been signed by both the parties. As per settlement arrived at between the parties all the case pending against the parties shall be withdrawn and an amount of ` 2.5 lacs has been agreed to pay to complainant-wife in lump sum towards permanent alimony. On the basis of the said agreement a joint petition under Section 13-B of the Hindu Marriage Act was also filed, which has already been allowed.

IN view of the settlement arrived at between the parties and also the fact that complainant has no grouse against the petitioners and she does not want to continue with the proceedings, I am of the considered view that continuation of impugned criminal proceedings between the parties would be an exercise in futility. The complainant herself does not want to pursue these proceedings and it shall be merely a formality and sheer wastage of precious time of the Court as complainant would not support the case of prosecution in view of compromise between the parties. It would be in the interest of the parties as well as in the larger interest of the soceital, peace and harmony and in order to save both the families from avoidable litigation that the compromise arrived at between them is accepted by this Court.
