JUDGEMENT

(1.) Respondent was tried for commission of offence punishable under Section 30 of the Indian Arms Act, 1959 (the Act for short) in FIR No.98 dated 12.5.2004 at police station Sadar Malou8t.

(2.) The trial Court, vide impugned judgment dated 16.12.2011, acquitted the respondent of the charge framed against him. Hence, the application under Section 378 (4) of the Code of Criminal Procedure, 1973 (Cr.P.C. for short) has been filed by the State with a prayer for grant of leave to file an appeal against the judgment dated 16.12.2011.

(3.) After hearing learned counsel for the applicant, I am of the opinion that the present application deserves to be dismissed.
