Learned counsel for the petitioner contends the present petition has been filed through Power of Attorney as the petitioner is out of country and he was declared P.O. because he failed to appear before the trial Court. Co-accused of the petitioner, namely, Jagga Singh, Narinder Singh, Raj Singh and Jarnail Singh were charge-sheeted by the trial Court and faced the trial and ultimately were acquitted by the trial Court vide judgment dated 21.4.2009. Learned counsel for the petitioner further submits that as per judgment of the trial Court, the complainant is neither owner nor in possession of the property where the alleged occurrence took place and keeping in view the facts and circumstances of the case, coaccused of the petitioner were acquitted of the charges by the trial Court.
