JUDGEMENT

(1.) This order shall dispose of Criminal Appeal No.896-DB of 2006 filed by Vinod Kumar son of Samuel Prem Prasher against the judgment of conviction dated 18.11.2006 passed by the learned Sessions Judge, Ambala, convicting the appellant for an offence punishable under Section 302 IPC and sentencing him to undergo imprisonment for life vide order of sentence dated 20.11.2006; and Criminal Revision No.154 of 2008 filed by Nacchattar Singh, father of the deceased Paramjit Kaur claiming enhancement in the sentence awarded to the accused.

The prosecution case was set in motion on the basis of the statement of Sandeep Bakshi son of Shri Banwari Lal resident of H.No.58, Housing Board Colony, Baldev Nagar, Ambala made to ASI Vinod Kumar on 19.08.2004 at about 2.05 am. Sandeep Bakshi in his statement (Ex.PC) stated that on 18.08.2004 at about 8.30/9.00 pm, when he was present at his house and the electricity supply was off due to power failure, he heard the shrikes of a lady from H.No.74 of Ram Saran located opposite to his house.

(3.) He came out from his room and noticed that a lady was crying and running down from the stairs in the house of Ram Saran. A person was following her. In the meantime, electricity supply was restored. The lady entered the ground floor of the house after opening the door. He has further stated that Vinod @ Guddu, the present appellant, who was residing with his relative Ram Saran for the last about 8 months followed her along with knife in his hand and within his sight Vinod @ Guddu caused many blows to the said unknown lady as a result of which the lady fell in the room near the Dewan.
