JUDGEMENT

(1.) This petition has been filed under Section 401 of the Code of Criminal Procedure, 1973 (Cr.P.C. for short) challenging the order dated 28.11.2008 passed by the trial Court, whereby the application filed by prosecution, under Section 319 Cr.P.C for summoning the petitioner as an additional accused to face trial, was allowed.

(2.) After hearing learned counsel for the parties, I am of the opinion that this petition deserves dismissal.
