JUDGEMENT

(1.) DEFENDANT J.S.Bhullar having failed in both the courts below has filed this second appeal.

(2.) RESPONDENTS /plaintiffs filed suit against the defendant/appellant for recovery of Rs. 9,46,200.00. Facts in this case are not very much in dispute. The defendant agreed to sell plot measuring 16 marlas i.e. 480 square yards to the plaintiffs for Rs. 4,98,000.00 and received the entire sale price and executed agreement dated 6.4.1998. However, in view of interim order dated 3.11.1997 passed by this Court in some matter, sale deeds of plots having area of less than 1000 square yards could not be registered.

(3.) THE defendant admitted the aforesaid factual position. However, the defendant pleaded that he was still ready and willing to execute the sale deed of the plot in favour of plaintiffs provided the stay granted by this Court is vacated.
