JUDGEMENT

(1.) This petition under Section 482 Cr.P.C. for quashing of FIR No. No.13 dated 30.3.2010 under Sections 420, 465, 468, 471, 120-B IPC registered at Police Station Phul District Bathinda.

(2.) The present FIR was registered on a communication sent by learned JMIC Phul. The allegations are that one Ranjit Kumar had moved an application before JMIC that the petitioner and his surety in collusion with each other had furnished forged and fabricated jamabandi on record to secure the release of the petitioner. Notice of this application was given to the petitioner and a report from the concerned Halka Patwari was called.

(3.) After notice, the Patwari stated that the said jamabandi was a fabricated document and does not bear his signatures. As per his record, surety Rama Singh is not the owner of the property mentioned in the jamababdi and no jamabandi has been prepared by the Revenue Authorities for the year 2010- 2011. Bail orders of the petitioner were cancelled and on a communication sent by the JMIC, the JMIC directed the SHO to register a case against the petitioners.
