(1.) By filing this revision petition under Article 227 of the Constitution of India, Arjun Singh has assailed order dated 11.02.2012 Annexure P-2 passed by learned Motor Accident Claims Tribunal, Karnal (in short, the Tribunal) thereby dismissing application Annexure P-1 moved by petitioner for premature release of his fixed deposit amount.
(2.) Petitioner and his wife Premwati filed claim petition under the Motor Vehicles Act, 1988 claiming compensation for death of their son Mahinder Singh caused in motor vehicular accident. Nirmala widow of Mahinder Singh was impleaded as proforma respondent. The Tribunal vide award dated 22.07.2011 awarded Rs 5,85,000/- as compensation to be shared equally by both the parents and the widow of the deceased. However, Premwati mother of the deceased had died during pendency of the claim petition and her share was ordered to be distributed to her legal heirs i. e. four sons as well as husband i. e. petitioner herein whereas share of the petitioner himself as well as share of Nirmala was ordered to be deposited in fixed deposits for three years.
(3.) Petitioner moved application Annexure P-1 for premature release of his fixed deposit amount for his daily necessities being old person. The said application has been dismissed by the Tribunal vide order Annexure P-2 which is under challenge in this revision petition.
