RAMESHO & OTHERS Vs. STATE OF HARYANA

JUDGEMENT

(1.) This judgment shall dispose of CRR Nos.115 and 485 of 2012, as both the petitions have arisen out of the common judgments of both the Courts below, passed in a case arising out of FIR No.243 dated 10.12.2003 u/ss 454/380 IPC, registered at P.S. Madhuban, Karnal.

(2.) Petitioners in both these petitions have laid challenge to the judgment and order dated 4.5.2010 and 6.5.2010 passed by Judicial Magistrate Ist Class, Karnal, whereby they were convicted under Sections 454/380 IPC and sentenced to undergo simple imprisonment for a period of one year for offence under Section 454 IPC and to pay fine of Rs.1,000/- each and also to undergo simple imprisonment for a period of one year for offence under Section 380 IPC and to pay fine of Rs.1,000/- each. In default of payments of fine, they were ordered to undergo further simple imprisonment for three months each.

(3.) Both these sentences were ordered to run concurrently. The appeal preferred against the aforesaid judgment was dismissed by Additional Sessions Judge, Karnal.
