JUDGEMENT

(1.) By way of this revision petition, Sadhu Ram @ Sadhu Singh, the petitioner has challenged the order dated 02.12.2011, vide which he has been summoned under the provisions of section 319 Cr.P.C. to stand trial for an offence punishable under section 498-A, 304-B and 302 IPC and the order dated 13.02.2012, vide which charge has been framed against the petitioner for an offence punishable under sections 498-A and 304-B with alternative charge under section 302 IPC.

(2.) The case was got registered by Jasbir Singh, a brother of Raj Bala, deceased, who claimed that his sister Raj Bala was married with Parveen Kumar on 12.05.2004. He claimed that his sister told him many times about her husband harassing her and telling her to bring Rs.50,000/- from her home for buying a motorcycle. He claimed that to satisfy that demand, he paid Rs.30,000/- but that could not make her husband happy. He has further stated that on 23.04.2011 he received a call from mother-in- law of Raj Bala that his sister was serious and was admitted to the hospital of Beni Pershad at Mahesh Nagar, Ambala Cantt. He has claimed that he reached the hospital with his wife and others and there he was told by his sister Raj Bala that she was beaten by her husband Parveen Kumar, sister-in- law Sonia and Sadhu Rai, Hardware Wala with sticks and rods and that she sustained injuries.

After recording the statement of Jasbir Singh, the complainant as PW-1, application was made under section 319 Cr.P.C. claiming that Sadhu Ram is maternal uncle of Parveen Kumar and that he alongwith Parveen Kumar and Sonia had beaten Raj Bala with danda and iron rod in which she suffered injuries. He claimed that there was evidence coming at the trial to prove that Sadhu Ram had also committed the offence and it was prayed that he be summoned as additional accused.
