(1.) The petitioner graduated in B.Sc. (Honours), Electronics from Delhi University. She applied for admission to Master Computer Application (MCA) Programme offered by 11 National Institutes of Technologies (NIT) across the country. She accordingly appeared in NIT MCA Common Entrance Test 2012 conducted by respondent No.2. On the basis of her high rank in merit, she was granted provisional registration with respondent No.3-College. Later, the petitioner was informed that her admission was cancelled on the ground that she had not studied mathematics in her Graduation. The information brochure for MCA course, as offered by NIT, is published by NIT, Warangal. The qualifying degree for appearing in the entrance test as prescribed is a Bachelor Degree atleast with one of the chosen subject of study as mentioned in the information brochure. The relevant portion of the eligibility conditions is as under:-
(2.) The petitioner claims that she had submitted her application on line and would fulfill the eligibility conditions. The permission to appear in the entrance examination was granted after due scrutiny of her application form. The petitioner obtained all India rank 264 in the entrance examination. The petitioner accordingly was allotted a provisional seat at NIT, Kurukshetra. A provisional admission letter was also issued. She deposited Rs. 10,000/- as provisional admission fee. On 27.6.2012, the petitioner sent an email seeking certain clarifications, when she was informed that she had not studied mathematics or any of its equivalent course listed in the information brochure. The admission granted to the petitioner was, thus, cancelled.
(3.) Worried petitioner, approached Principal, Bhaskaracharya College of Applied Sciences, University of Delhi, where she had studied her B.Sc. Course. The Principal issued a letter to respondent No.2, clarifying that mathematical physic I, II and III alongwith numerical analysis covers the spectrum of papers required for NIT Institutions. Respondents did not respond to the said information supplied by the petitioner to them. The petitioner served a legal notice and also approached Ministry of Human Resources on 4.7.2012. The petitioner has obtained a certificate dated 9.7.2012 from the Department of Electronic Science, University of Delhi to confirm that the students of B.Sc. (Honours), Electronics do study three mathematics papers. This, as per the petitioner, would meet the requirement of the course study, making her eligible for admission to NIT. The petitioner also approached the Hon'ble High Court of Delhi, but she withdrew her writ petition with liberty to approach this Court.
