(1.) Petitioner was tried by the trial court for commission of offence punishable under Section 279/304 of the Indian Penal Code ('IPC' for short). The trial court vide judgment/order dated 25.10.2010 convicted and sentenced the petitioner qua commission of offence under Section 279, 304-A IPC. In an appeal, the appellate court maintained the conviction of the petitioner under Section 279, 304-A IPC vide order dated 10.5.2012. However, the sentence as ordered by the trial court was reduced to six months rigorous imprisonment under Section 304-A IPC and rigorous imprisonment for two months under Section 279 IPC.

During the course of arguments, learned counsel for the petitioner has not challenged the conviction of the petitioner under Section 279, 304-A IPC but has submitted that in view of the compromise effected between the parties, the sentence qua imprisonment of the petitioner be reduced to already undergone by him.
(3.) Affidavits of the legal representatives of the deceased with regard to compromise effected between the parties have been placed on record. A perusal of the judgment passed by the appellate court also reveals that compromise had been effected between the parties.
