(1.) The petitioners, by way of instant petition under Section 438 Cr. P. C. , seek pre-arrest bail in the case arising out of FIR No. 370 dated 21.6.2012 under Sections 406, 420, 447, 448, 467, 468, 120-B IPC, registered at Police Station City Jind, District Jind. Notice of motion was issued granting interim protection to the petitioners, vide order dated 2.8.2012 Learned counsel for the petitioners submits that petitioners, in compliance of the order dated 2.8.2012, have joined the investigation and also cooperated with the investigating agency. He further submits that since nothing is to be recovered from the petitioners, their custodial interrogation is not required. Further, as the civil suit of the complainant is also pending, the instant petition deserves to be accepted.

Learned counsel for the State, on instructions from ASI Ramesh Kumar, Police Station City Jind, submits that it is correct that petitioners have joined the investigation and cooperated with investigating agency, in compliance of the order dated 2.8.2012, passed by this Court. He further submits that pendency of the civil suit filed by the complainant, vide Annexure P-1, being a matter of record, he would not be in a position to controvert the same.
(3.) However, he submits that since allegations against the petitioners are direct and specific, they are not entitled for pre-arrest bail.
