JUDGEMENT

(1.) The present revision petition has been filed against the judgment of conviction and Order of sentence dated 08.09.2010 passed by the Sub Divisional Judicial Magistrate, Baba Bakala, vide which, the petitioner has been convicted and sentenced to undergo rigorous imprisonment for one year and to pay a fine of Rs.5,000/- and in default of payment of fine to further undergo rigorous imprisonment for 15 days under Sections 61/1/14 of the Punjab Excise Act, as well as, the judgment dated 09.04.2012 passed by the Additional Sessions Judge (Fast Track Court), Amritsar, whereby, the appeal filed by the petitioner has been dismissed and judgment of conviction and Order of Sentence passed by the Sub Divisional Judicial Magistrate, Baba Bakala was upheld.

(2.) Briefly, the facts of the case are that FIR No.3 dated 13.01.2007 was registered against the petitioner under Sections 61/1/14 of the Punjab Excise Act as he was found keeping in his conscious possession 570 MLs of illicit liquor.

(3.) The present revision petition has been filed after losing before both the Courts below.
