JUDGEMENT

(1.) This is a petition under Section 482 Cr.P.C. for quashing of FIR No. 48 dated 02.03.2010 under Section 420, 465, 467, 468, 471, 120-B IPC, Police Station Model Town, Ludhiana City (Annexure P-1) which was got registered at the instance of respondent No. 3 - complainant against the present petitioners on the basis of the compromise dated 27.05.2010 arrived at between the parties. Copy of the same has been placed on record as Annexure P-5.

In the present case, the said FIR was got registered at the instance of respondent No. 3, who is working as Assistant Collection Manager with respondent No. 2 with the allegation that the husband of petitioner, namely, Suresh Kumar (since deceased) had taken loan on some forged and fabricated documents from the respondent Company. Now, the petitioner and the respondent company has entered into the memorandum of understanding dated 27.05.2010 that on receipt of the entire loan amount, the respondent-company will not proceed with the said case registered against the petitioner and others.

Respondent No. 3, who is working as Collection Manager with respondent No. 2 - company is present in the Court today and stated that the entire loan amount has already been repaid by the petitioner and as such, the company has no objection if the said FIR is quashed. Respondent No. 2 is duly authorized respondent No. 3 to represent and appear on behalf of Indiabulls Housing Finance Limited in the present petition. Authority letter is already on record.
