JUDGEMENT

(1.) Feeling aggrieved against the alleged inaction on the part of the investigating agency in FIR No.27 dated 01.03.2007, under Sections 279, 337, 427 and 304 IPC, registered at Police Station Mukerian, the petitioner has approached this Court by way of instant petition under Section 482 Cr.P.C. praying for impartial investigation through an independent agency like CBI.

(2.) Notice of motion was issued and pursuant thereto, reply by way of affidavit dated 23.07.2009 of Dharmvir Singh, Deputy Superintendent of Police, Sub Division Mukerian, District Hoshiarpur, has been filed.

(3.) Learned State counsel, on instructions from ASI Satwant Singh, Police Station Mukerian, District Hoshiarpur, submits that the untraced report was presented in the present case which was duly accepted by learned Sub Divisional Judicial Magistrate Dasuya-cumPresiding Officer, Mobile Court Mukerian, vide order dated 03.07.2008.
