JUG LAL Vs. BISHNA RAM AND OTHERS

JUDGEMENT

(1.) This is second appeal by defendant no. 3 Jug Lal having failed in both the courts below.

(2.) Suit was filed by respondent no.1/plaintiff Bishna Ram (since deceased and represented by legal representatives) against defendant no. 3/appellant and proforma respondents no. 2 and 3 as defendants no. 1 and 2. It is undisputed that plaintiff has his house in Abadi. It is also undisputed that there is passage comprising of khasra no. 122 connecting old Abadi with new Abadi.

(3.) Grievance of the plaintiff in the suit was that the defendants were creating obstacles in the disputed passage. Plaintiff sought permanent injunction restraining the defendants from doing so.
