JUDGEMENT

(1.) The Revision petitioner is the defendant in the suit laid by the respondent herein.

(2.) The defendant during the pendency of the suit laid by the respondent filed an application before the trial Court praying to dismiss the suit laid by the respondent on the ground that the Civil Court has no jurisdiction to deal with the service matter of the respondent in view of the statutory bar found incorporated under Section 28 of the Administrative Tribunals Act, 1985.

(3.) The above application filed by the Revision petitioner was dismissed by the trial Court on the ground that the suit was filed by the respondent aggrieved by the harassment and revengeful attitude of the Revision petitioner herein in his personal capacity. Kendriya Vidyalaya Sangathan, wherein the respondent was serving as a teacher was not a party to the suit. The trial Court having observed that the contentions raised in the plaint do not fall under the domain of the service law covered under Section14 of the Administrative Tribunals Act, 1985, dismissed the above application.
