JUDGEMENT

(1.) Prosecution case, in brief, was that a loan of Rs. 1,50,000/- for purchase of tractor implements was sanctioned by Patiala Primary Co-operative Agricultural Development Bank Ltd., Patiala (hereinafter referred to as the bank) in favour of the complainant.

(2.) The complainant was informed by the bank official that the cheque in pursuance to grant of loan amount had been handed over to petitioner Dharam Singh. The complainant met the petitioner but he was not supplied the implements nor the money was returned to him.

(3.) Thereafter, the complainant came to know that the petitioner was not preparing any implements for the tractor but was only preparing gates and grills. Thus the petitioner had cheated the complainant.
