JUDGEMENT

(1.) By way of this revision petition, the petitioner has challenged the order dated 18.8.2011 of the Additional Sessions Judge, (Ad hoc), Fast Track Court, Ropar, whereby his prayer for leading additional evidence was rejected. It is a matter of record that before the appellate Court, while moving application for permission to lead additional evidence, the petitioner had sought to prove on record certain sale deeds alleged to have been executed by the petitioner in favour of one Hardeep Singh son of Bant Singh.

As per the averments made in this petition, the petitioner filed complaint No.67 dated 12.9.2005 under Section 138 of the Negotiable Instruments Act, 1881 against Gurdial Singh (wrongly typed as Ashok Kumar in the judgment, Annexure P-1). The said complaint was dismissed by the Additional Chief Judicial Magistrate, Rupnagar, vide his judgment dated 19.5.2010 (Annexure P-1). The petitioner filed an appeal against the aforesaid judgment, which is stated to be pending in the Court of Sessions Judge, Ropar.

(3.) During the pendency of the said appeal, the petitioner moved an application under Section 391 CrPC for granting him permission to lead additional evidence by placing on record certain sale deeds dated 19.6.2002, 23.12.2002, 6.3.2003 and 1.10.2003 executed by the petitioner in favour of Hardeep Singh son of Bant Singh, resident of Morinda, Tehsil and District Ropar.
