JUDGEMENT

(1.) The present criminal revision petition is directed against the judgment dated 14.5.2009, passed by the learned Additional Sessions Judge (A), Fast Track Court, Sangrur, dismissing the appeal of the petitioners against the judgment of conviction and order of sentence dated 20.12.2007, passed by the learned Judicial Magistrate Ist Class, Malerkotla.

(2.) Facts First. Shorn of detailed background of the matter, it would suffice to refer to the basic facts of the case relevant and necessary for disposal of the instant petition. A complaint under Section 138 of the Negotiable Instruments Act, 1881 (for short 'the Act'), was filed by the complainant-respondent Mehma Singh against the petitioners-accused. The complainant was found successful in brining home the guilt against the accused. Accordingly, the learned trial Court held the accused guilty and recorded the conviction for the offence punishable under Section 138 of the Act, vide its judgment of conviction dated 20.12.2007.

(3.) Accordingly, the convict was sentenced to undergo rigorous imprisonment for a period of two years and to pay fine of Rs.500/-. In default of payment of fine, he was ordered to undergo further rigorous imprisonment for a period of one week, vide order of sentence dated 20.12.2007.
