JUDGEMENT

(1.) This is a petition filed by the petitioner under Section 438 of the Code of Criminal Procedure seeking concession of pre-arrest bail in case FIR No.234 dated 11.06.2012 registered under Sections 148/149/323/341/ 379/506/120-B IPC at Police Station Ambala Cantt, District Ambala.

(2.) Learned counsel for the petitioner contends that petitioner is running a Fastway Mahalaxmi Cable Network Pvt. Ltd. in Ambala and is an area operator. Learned counsel further contends that there are also other area operators in the same city. Number of other distributors are there. One of the distributor is Super Sonic Cable Network which is being run by the complainant at whose instance the present FIR has been lodged.

(3.) I have heard learned counsel for the petitioner. This apparently appears to be a business rivalry. Earlier the petitioner had sought direction from this Court. In pursuance to that direction, nothing was recovered, although raids were conducted against the complainant party. The petitioner having failed in that exercise now in connivance with its staff disrupted by cutting cables, from which appears that petitioner is indulged in the activities of theft and in this manner has committed theft of cables which has affected the cable network of Super Sonic Network Cable whose distributor is complainant.
