(1.) Prayer in this petition, filed under Section 438, Cr.P.C., is for grant of anticipatory bail to the petitioner, Harjot Singh, who has been booked for committing the offences punishable under Sections 420, 467, 468 and 471, IPC, in FIR No. 58, dated 19.5.2012, registered at Police Station, Sarabha Nagar, Ludhiana.
(2.) The brief facts of the case are that the petitioner is the step-son of respondent No. 2-complainant, Jasleen Kaur. According to the allegations, respondent No. 2-complainant along with her minor children was residing in Jagjeet Nagar, Ludhiana. Her step-sons, namely, Harjot Singh (petitioner) and Jagjot Singh, were also residing there in the said house. Her father-in-law, Raggi Harbans Singh Jagadhri-wale, and husband Gurcharan Singh, had ample movable and immovable property. After the death of the husband of respondent No. 2-complainant, the petitioner and his brother Jagjot Singh started misbehaving with her. On 24.4.2010 and 5.9.2010, Harjot Singh (petitioner) and his brother Jagjot Singh had withdrawn an amount of Rs. 4,25,000/- from the bank account of respondent No. 2-complainant after forging her signatures. It was further alleged that Harjot Singh (petitioner) in connivance with Jagjot Singh and his sister Ravinder Kaur operated the bank accounts belonging to respondent No. 2- complainant and withdrew a huge amount. On the basis of the above broad facts, an FIR No. 58, dated 19.5.2012, under Sections 420, 467, 468 and 471, IPC, was registered at Police Station, Sarabha Nagar, Ludhiana, wherein the petitioner was nominated as an accused.
(3.) The petitioner filed an application for anticipatory bail before the learned Additional Sessions Judge, Ludhiana, which was dismissed on 14.7.2012 and, hence, the present petition for grant of anticipatory bail.
