JUDGEMENT

(1.) HEARD the submissions made by learned counsel appearing on either side.

(2.) THE plaintiff who was non-suited both by the trial Court as well as the first appellate Court in a suit laid by him for declaration that he is the owner of the property and also for permanent injunction restraining the defendant from dispossessing the plaintiff from the suit property or alienating the same has come forward with the present appeal.

(3.) PER contra, the defendant has set up a plea that the plaintiff ceased to be the owner of the property inasmuch as, he had executed the sale deed dated 4.2.2003 and registered on 5.2.2003 in respect of the subject suit property. Mutation also has been sanctioned in the name of the defendant. The loan transaction set up by the plaintiff has been vehemently denied by the defendant.
