SUKHPAL KAUR Vs. STATE OF PUNJAB

JUDGEMENT

(1.) The appellant has filed the present appeal against the judgment and order dated 7.5.2012 passed by the Special Judge, Sri Muktsar Sahib, whereby she has been convicted under Section 15 of the Narcotic Drugs and Psychotropic Substances Act, 1985 (for short the NDPS Act ) in FIR No.63 dated 16.5.2008 registered at Police Station Lambi and sentenced to undergo rigorous imprisonment for a period of three months and to pay a fine of Rs.1,000/- and in default of payment of fine, to further undergo rigorous imprisonment for seven days.

(2.) According to the case of the prosecution, the appellant was apprehended on 16.5.2008 and upon search of the plastic bag being carried by her, 5 kgs. of poppy husk was recovered from her.

(3.) This appeal was admitted vide order dated 15.5.2012. Upon a prayer for suspension of sentence, notice was issued to the State of Punjab for today. However, after hearing learned counsel for the parties and with the consent of the learned counsel, the main appeal itself is taken on Board.
