(1.) Appellant has preferred this appeal challenging his conviction and sentence under Sections 307 and 302 of the Indian Penal Code, 1860 (IPC for short), as ordered by the trial Court vide judgment/ order dated 9.12.2008.

The prosecution story, in brief, is that Assistant Sub Inspector Lakhwinder Singh recorded the statement of Mandeep Kaur on 12.10.2004 in Civil Hospital, Batala, where she was admitted in an injured condition. Mandeep Kaur stated in her statement that on 12.10.2004 at about 8.30 a.m. she was going along with her sister Kuljit Kaur towards Ghuman Hospital, where they were working as nurses. At about 9.15 a.m., when they reached Lakkar Mandi near liquor vend/ shop, Narinder Singh @ Ninda was going ahead of their rickshaw on foot. When they reached near him, he immediately threw acid on her and her sister Kuljit Kaur, which he was holding in a glass in his hand. The acid fell on her forehead, neck, chest, arms and legs and on the face, hands, chest, left leg of Kuljeet Kaur. Both of them raised alarm on account of burning sensation on their body. Narinder Singh @ Ninda fled away from the spot. Rickshaw puller and Ashwani Malhotra took them to Civil Hospital, Batala.
(3.) On the basis of the statement of the complainant formal FIR No.146 was registered on 12.10.2004 at police station City Batala under Section 307 IPC.
