(1.) Petitioner has filed this petition under Section 439 of the Code of Criminal Procedure, 1973 seeking regular bail in FIR No. 175 dated 3.9.2011 under Section 148, 149, 224, 225, 332, 341, 186, 307 of the Indian Penal Code, Section 25 of the Arms Act, 1959 and Section 3 of Prevention of Damage to Public Property Act, 1984 registered at Police Station Nagina, District Mewat. Learned counsel for the petitioner has submitted that the petitioner is in custody since 9.11.2011. It was a case of no injury.
(2.) Learned State counsel, on the other hand, has opposed the petition.
(3.) After hearing the learned counsel for the petitioner and the learned State counsel, I am of the opinion that the instant petition deserves to be allowed.
