JUDGEMENT

(1.) In this first appeal, Sukhwinder Singh has impugned order dated 06.08.2012 passed by learned Additional District Judge, Amritsar. The Punjab Financial Corporation (PFC) respondent filed applications under Sections 31 and 31 (1) (aa) of the State Financial Corporations Act, 1951 against the appellant herein. The said application was allowed ex-parte vide judgment dated 01.05.2003.

Appellant moved application under Order 9 Rule 13 read with Section 151 of the Code of Civil Procedure (in short CPC) for setting aside ex-parte judgment and decree dated 01.05.2003 along with application for condonation of delay alleging that the appellant was not served personally in the main case and ex-parte judgment and decree have been obtained by concealment of facts and false representation. The appellant learnt of the same on 06.05.2010 and accordingly moved application for setting aside the ex-parte judgment and decree.

(3.) Respondent PFC opposed the applications.
