(1.) Petitioner has filed this petition under Section 482 of the Code of Criminal Procedure for quashing FIR No. 234 dated 12.12.2003 (Annexure P-1), under Sections 406, 420,120-B of the Indian Penal Code ('IPC' for short), registered at Police Station Division No.1 Pathankot and subsequent proceedings arising therefrom on the basis of compromise arrived at between the parties.
(2.) Learned counsel for the petitioner has submitted that the parties have arrived at a compromise . The entire amount in question has been received by respondent No.2-Nirmal Singh in execution proceedings in the civil litigation.
(3.) Karambir Gill, son of respondent No.2-Nirmal Singh has appeared on behalf of respondent No.2-Nirmal Singh on the basis of special power of attorney executed by respondent No.2 in his favour. He has stated that in execution proceedings in civil litigation, the entire amount in question has been received by his father. His father has no objection, if the FIR in question is ordered to be quashed. He has tendered his affidavit alongwith original special power of attorney on record.
