JUDGEMENT

(1.) This shall dispose of Criminal Appeal No. 842-DB of 2011 and Murder Reference No. 5 of 2011.

(2.) Accused Ram Raji, Kailash Devi, Rajender Parkash and Sardara were sent up for trial for the offences under Section 302/201/364 read with Section 34 IPC.Accused Rajender Parkash and Sardara were acquitted of all the charges framed against them but accused Ram Raji and Kailash Devi were convicted of the offence under Section 302 read withSection 34 IPC. Accused Ram Raji was also convicted under Section 201 IPC. Accused Ram Raji was sentenced to death for commission of offence under Section 302 read with Section 34 IPC. For the offence under Section 201 IPC, he was also sentenced to undergo rigorous imprisonment for two years and to pay a fine of Rs.5000/- and in default, to further undergo rigorous imprisonment for a period of two months whereas Kailash Devi was sentenced to undergo life imprisonment for the offence under Section 302 read with Section 34 IPC and to pay a fine of Rs.10,000/- and in default of payment of fine, to further undergo rigorous imprisonment for a period of four months. Murder reference has been forwarded by the District and Sessions Judge, Jind, while both accused, Ram Raji and Kailash Devi have preferred the above-mentioned criminal appeal.

(3.) The brief case of the prosecution as emerged from the evidence let in by the prosecution is as follows:
