GURDEV SINGH Vs. STATE OF PUNJAB

JUDGEMENT

(1.) Gurdev Singh has been prosecuted for the offence under Section 306 IPC for abetment to commit suicide of his brother's wife Baldish Kaur, consequently, vide judgment dated 14.7.2001, he was sentenced to undergo rigorous imprisonment for five years and to pay fine of Rs.5000/- under Section 306 IPC.

(2.) On 1.6.2000, at about 9.30 PM, after visiting his relatives, when the complainant returned to his village, he found his wife Baldish Kaur in flames and crying in the compound. On enquiry, she disclosed that she having fed up with the harassment given to her by the accused, had set herself ablaze. The complainant shifted her to Civil Hospital, Jalandhar and informed Santokh Singh and Surinder Singh brothers of Baldish Kaur. She on their arrival disclosed about the cause of her death, to them and she died on 2.6.2000 at about 9.30 AM.

(3.) On the basis of the aforesaid statement Ex.PE, made by the complainant, FIR Ex.PE/2 was recorded by ASI Jagan Nath. The accused was arrested and the case was investigated. On completion of the investigation, charge report under Section 173 Cr.P.C. was submitted against him.
