DEEPAK @ OM PAL Vs. STATE OF HARYANA

JUDGEMENT

(1.) By this common order, (1) Criminal Misc. No. M-367 of 2012 preferred by Deepak @ Om Pal; (2) Criminal Misc. No. M-1148 of 2012 filed by Chakarwarti and (3) Criminal Misc. No. M-1149 of 2012 filed by Sukhbir @ Gaddar shall be decided together.

(2.) Petitioners namely Deepak @ Om Pal, Chakarwarti and Sukhbir @ Gaddar have approached this Court under Section 439 Cr.P.C. praying for grant of regular bail to them in a case arising out of FIR No. 15 dated 13.01.2011 registered at Police Station Manesar, District Gurgaon under Sections 392 and 34 IPC and Section 25/54/59 of the Arms Act, 1959. It is stated that offences punishable under Sections 395 and 397 IPC were added later-on.

(3.) Counsel for the petitioners have placed reliance upon the order dated October 13, 2011 passed by a Coordinate Bench of this Court in Criminal Misc. No. M-22220 of 2011, whereby bail was granted to the co-accused Surender. The order granting bail to co-accused Surender reads as under:
